Terms of Service

These Terms of Service ("Terms") govern your use of Michi-Niwa ("the Service"), operated by Shinkofa. By using the Service, you agree to these Terms.
1. Acceptance of Terms
By accessing or using Michi-Niwa, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Service Description
Michi-Niwa is an AI-powered Discord community management platform that provides: - Server structure auditing and optimization - Blueprint generation for Discord server configuration - Server migration and backup tools - AI-powered moderation - Analytics and management dashboard The Service integrates with Discord via OAuth2 and bot permissions.
3. User Accounts
You authenticate via Discord OAuth2. You are responsible for your Discord account security. You must not share your access or use the Service for unauthorized purposes. You must be at least 13 years old (or 16 in some EU countries) to use the Service.
4. Acceptable Use
You agree not to: - Use the Service to violate Discord's Terms of Service - Attempt to access servers or data you are not authorized to manage - Use migration/backup features to copy servers without proper authorization - Reverse engineer, decompile, or exploit the Service - Use the Service for illegal activities - Abuse rate limits or attempt to overload the Service
5. Discord Data & Migrations
When using backup and migration features: - You must be the server owner or have explicit authorization from the server owner - You are responsible for notifying server members before migration operations - Message backups are temporary and automatically deleted after the configured retention period - Any member can opt out of message backups using /niwa-optout - Re-injected messages are clearly marked as migrated content - You must comply with applicable data protection laws (GDPR, etc.)
6. Intellectual Property
The Service, its code, design, and AI models are the property of Shinkofa. You retain ownership of your content (server configurations, messages). By using the Service, you grant us a limited license to process your content solely to provide the Service. We do not claim ownership of your Discord server data.
7. Payments & Subscriptions
The Service offers Free, Pro, and Agency tiers. Paid subscriptions are processed via Stripe. You can cancel at any time through the Stripe customer portal. Refunds are handled on a case-by-case basis. We reserve the right to change pricing with 30 days notice.
8. Termination
You may stop using the Service at any time by removing the bot from your server and deleting your account. We may suspend or terminate your access if you violate these Terms. Upon termination, we delete your data as described in our Privacy Policy.
9. Disclaimers
The Service is provided "as is" without warranties of any kind. We do not guarantee that AI-generated suggestions, audits, or moderation actions will be perfect. You are responsible for reviewing and approving all actions before they are applied to your Discord server.
10. Limitation of Liability
To the maximum extent permitted by law, Shinkofa is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.
11. Governing Law
These Terms are governed by the laws of Spain and the European Union. Any disputes shall be resolved in the courts of Malaga, Spain.
12. Changes to These Terms
We may update these Terms from time to time. Significant changes will be announced via the bot in connected servers and on this page. Continued use of the Service after changes constitutes acceptance.
